Reservation conditions

 

The website www.tombohouse.com (hereinafter the Website) is the property of Tombo House Limited (the Company) with registered office in Kenya, Diani Beach, Diani Beach Road, PIN Po52076108V and Tel. 002540708085141. By using the website you can proceed with the reservation of the properties that are part of Tombo House Limited.

 

This document (hereinafter “General Terms and Conditions”) defines the conditions established by Tombo House for the use of the Website and the corresponding reservation services. These Terms and Conditions, together with Tombo House's Privacy Policy, are deemed to be fully understood and accepted by the User navigating the Website. To proceed with a reservation, it is necessary to first understand and accept the Terms and Conditions and the Privacy Policy.

 

The term “User” refers to any natural and/or legal person who accesses the Website or uses its services.

1. Scope.

 

These Terms and Conditions apply to all online visits and bookings made on the website. Navigation on the website, use of the booking system and all other services offered on the website imply that the user has understood and accepted these general terms and conditions

 

.2. The service offered by the website.

 

The Website is an online platform owned by Tombo House, which allows them to offer their respective rooms for reservation and, on the other hand, allows visitors to the Website to make a reservation.

 

By booking via the website, the user establishes a direct contractual relationship with the receiving property where the reservation is made. From the moment of the above-mentioned reservation, the Company becomes the exclusive intermediary between the User and the Receiving Property and communicates to the Accommodation all relevant details of the booking and at the same time sends the User a confirmation email on behalf of the Receiving Property.

 

When offering these services, we transmit the information provided to us by the receiving accommodation, which therefore has sole responsibility for all information available on the website and for updating prices and availability.

 

Although we provide our services with care and diligence, we cannot verify and guarantee the accuracy, completeness and precision of the information provided, nor can we be held liable for any errors (including content and typographical errors) or interruptions in service (due to a temporary and /or partial failure, due to repair work, updating or maintenance of the website or otherwise), inaccurate, misleading or false information or due to non-delivery. Each receiving property is at all times responsible for the accuracy and completeness of the (descriptive) information provided, including the prices and availability displayed on the website, in accordance with the general terms and conditions of the respective receiving property.

 

Some reservations may be subject to restrictions or conditions, such as cancellation and/or modification of the reservation. Therefore, before making a reservation, it is important to carefully check whether such conditions exist in the reservation details and prices.

 

3. Intellectual Property Rights.

 

All content present on the website as well as on related websites and portals, including all data, information, communications, editorial content, photos, videos, graphics, designs, logos, trademarks and, in general, all materials or services contained therein, is, unless otherwise stated, the property of Tombo House or providers of bookable services and must be considered protected by copyright and intellectual property rights. Therefore, it is expressly prohibited to reproduce, copy and/or use the trademark, logo, website, content or anything else present on this website and related websites and web portals, unless: this was expressly approved in writing. The images on the website are provided for viewing purposes only and may not be saved or downloaded in any form.

 

4. Reservation Policies.

 

Through the website it is possible to determine the availability of rooms based on the dates chosen by the user for the specified accommodations. The results returned by the system in real time show only the structures that have uploaded the availability for the room type chosen by the user and indicate for each type the conditions of sale, such as the price (expressed in $). Inclusion or non-inclusion of taxes and breakfast, contractual penalties, payment methods, change and cancellation conditions. For each individual booking, the website clearly and precisely sets out the purchasing conditions.

 

Once the user has found the solution that best suits their needs, the reservation requires the entry of personal details and credit card information in order to deduct the amount for the selected service. The user is responsible for the authenticity and accuracy of the information provided on the website.

 

5. Amount and method of payment

 

Payment of the amount associated with the reservation will be deducted by Tombo House from the credit card provided by the user at the time of booking or sent to Tombo House via bank transfer. By booking the room, the user authorizes the transaction with Tombo House in accordance with the specified conditions.

 

Our prices and offers are non-refundable. The amount must be paid in full when booking. Before booking, please carefully inform yourself about any conditions and details about the room and the prices.

 

Once the booking is made, Tombo House will send the user a confirmation email with full details of the confirmed booking.

 

The reservation is not considered complete until the confirmation email is received.

 

The guest has 24 hours after the booking has been made to send the amount to Tombo House or to cancel the booking within 24 hours. This cancellation is free of charge within 24 hours. After 24 hours the cancellation fee is the full amount of the booking.

If an advance payment is required at the time of booking, the success of the reservation will depend on the satisfactory outcome of the transaction by credit card or other payment method specified in the Conditions of Sale.

 

If an error and/or technical failure occurs at the time of booking, the reservation will be considered not completed and the Company will immediately inform the User. In this case, the reservation must be made again and the company declines any liability that may arise.

 

Tombo House declines all responsibility for any misuse or fraudulent use of the credit card, as well as for any damage that may arise from transactions carried out using the credit card that is beyond its direct control.

 

6. Processing of personal data and cookies.

The company respects the privacy of users.

 

7. Applicable law, exclusive jurisdiction and language of the General Terms and Conditions.

 

This website, the policies relating to the handling of personal data and the general terms and conditions are subject to the laws in force in Kenya.

 

The User accepts the exclusive jurisdiction of the Judicial Authority of Kenya to resolve any disputes relating to the validity, application, interpretation and execution of the provisions of the General Terms and Conditions and/or the Privacy Policy and also acknowledges the exclusive and binding jurisdiction of the Judicial Authority.

8. Language of the General Terms and Conditions and Final Provisions.

 

The original text of the General Terms and Conditions and the Privacy Policy was written in German. The original German text can be translated into other languages. The translated versions should be considered unofficial and are for informational purposes only and have no legal value. In the event of disputes regarding application or interpretation, reference is made exclusively to the original version in German for all legal effects and purposes and at all locations.

 

9. The possible invalidity of one or more clauses or parts thereof does not mean that the general terms and conditions or the rest of the same clause are considered invalid.

 

The reservation is personal and cannot be freely transferred without the prior consent of Tombo House.
